ONLY FOR LATIN AMERICAN PERSONS THAT ARE U.S. CONTINENTAL RESIDENTS BUT INCLUDING PUERTO RICO, AND EXCLUDING HAWAI, ALASKA AND GUAM . NO PURCHASE NECESSARY.
1. ELEGIBILIDAD
Esta promoción (en adelante la “Promoción”) es NULA ALLI DONDE NO ESTE PERMITIDA POR LA LEY. Sólo podrán participar residentes legales de los Estados Unidos y mayores de 18 años que hayan nacido en Latinoamérica pero vivan en Estados Unidos continental, incluyendo Puerto Rico y excluyendo Hawai, Alaska y Guam, en el momento de envío del registro. No son susceptibles de participar los empleados de Terra Networks Operations, Inc. (con sus matrices, afiliadas, filiales, agentes, u otros representantes a la que colectivamente nos referiremos como “Terra”) y sus familiares inmediatos (definidos como padres, cónyuges, hijos, hermanos y abuelos o quienes con ellos convivan).
1. ELIGIBILITY
This promotion (the “Promotion”) is VOID WHERE PROHIBITED BY LAW. Entry is open to anyone who was born in a Latin American country and is a legal U.S. resident and at least 18 years old and lives in the Continental United States, ,but including Puerto Rico and excluding Hawai, Alaska and Guam, at the time of registration. Employees and their immediate family (defined as parents, spouse, children, siblings, and grandparents and other household members) of Terra Networks Operations, Inc., (together with its parents, affiliates and subsidiaries, agents, and other representatives, collectively referred to herein with as "Terra") are NOT eligible to participate.
2. PARA PARTICIPAR
Para participar, los usuarios tendrán que registrar sus datos básicos en un formulario de Terra.
Sólo se podrá participar en línea a través del portal de Terra http://www.terra.com/especiales/suenoamericano/promo/index.html y durante el periodo desde el 16 de septiembre de 2003 hasta el 15 de diciembre de 2003, aunque Terra siempre se reserva el derecho de notificar de cualquier modificación o extensión de dicho periodo. Cada participante tendrá sólo una posibilidad de participar por cada carta. La Promoción se limita a una carta por persona. Todos los registros deberán ser enviados antes de las 11:59 E.T. p.m del día de finalización de la promoción. Todos los registros serán propiedad exclusiva de Terra. 2. TO ENTER
To participate, the users must register in Terra. Entries must be made online in the following site: http://www.terra.com/especiales/suenoamericano/promo/index.html, during the period beginning on September 16, 2003 and ending on December 15, 2003 although Terra reserves the right to modify or extend the aforementioned period. ONLY those participants who have previously registered on www.terra.com may enter the Promotion and be eligible for prizes.
Each entrant will receive one chance to win per letter. The Promotion is limited to one letter per person. All online entries must be submitted and received by Terra on or before 11:59:00 E.T. p.m. on the end date of Promotion. All entries become the exclusive property of Terra. For information regarding Terra's privacy policies, please go to http://www.terra.com/info/privacidad. Terra reserves the right to limit the number of entries to the Promotion for any or no reason at any time.
3. SELECCION Y NOTIFICACION DE LOS POTENCIALES GANADORES
El ganador será elegido por Terra mediante una decisión que se realizará el 16 de diciembre de entre todos los registros elegibles recibidos y anunciada tan pronto ubiquemos al elegido. Al ganador, se exigira comprobación de su lugar de nacimiento en Latinoamerica. En el caso que exista duda en cuanto a la identidad de un participante, se presumirá titular el que tenga la cuenta de correo electrónico abierta y pueda demostrarlo según los terminos siguientes. Terra podrá exigir al ganador prueba de titularidad de la cuenta de correo desde la que se ha recibido el registro ganador. “Titular Autorizado” significa la persona natural vinculada a una cuenta de correo electrónico por un proveedor de acceso a Internet, un proveedor de servicios en línea o cualquier otra entidad que sea responsable de asignar direcciones de correo electrónico para el dominio asociado con la dirección de correo enviada (ej. Trabajo, institución educativa....)
El ganador será notificado por correo electrónico o teléfono (“Notificación”) en los días siguientes al sorteo. Si el ganador no está localizable vía correo electrónico o teléfono en un plazo de setenta y dos (72) horas desde la Notificación, Terra se reserva el derecho de seleccionar un ganador alternativo.
Los participantes garantizan a Terra el derecho a utilizar y publicar su nombre y estado de residencia en línea o por escrito o por cualquier otro medio, en relación con la promoción, o cualesquiera otras promociones en ella relacionadas, salvo allí donde la ley lo prohíba. La aceptación del premio constituye autorización a Terra y sus agencias de publicidad y promoción para usar el nombre del ganador, voz y apariencia para propósitos publicitarios y promocionales sin compensación adicional, salvo si la ley lo prohíbe.
3. SELECTION AND NOTIFICATION OF POTENTIAL WINNERS
The winner will be selected by Terra on or about December 16, 2003 from among all eligible entries received and announced as soon as we contact the winner. The winner is required to prove his or her birth in a Latin American country. In the event of a dispute regarding who submitted the online entry (email), the entry shall be deemed submitted by the Authorized Holder (as defined below) of the email account. Winners may be requested to provide Terra with proof that such person is the Authorized Holder (as defined below) of the email address associated with the winning entry. “Authorized Holder” shall mean the natural person assigned to an email address by an Internet access provider, on-line service provider, or other organization that is responsible for assigning email addresses for the domain associated with the submitted email address (e.g., business, educational institution, etc.).
The potential winner will be notified by e-mail and/or telephone (the “Notification”) after the determination. If a potential winner is unreachable via e-mail or telephone within seventy-two (72) hours after the Notification is sent, Terra will select an alternate winner.
Entrants grant Terra the right to use and publish their proper name and state of residence, online and in print, or in any other media, in connection with the Promotion, or any promotions related thereto, unless prohibited by law. Acceptance of a prize constitutes permission for Terra and its advertising and promotional agencies to use winners’ names, voices, and likenesses for advertising and promotional purposes without additional compensation, unless prohibited by law.
4. PREMIOS
Un (1) ganador recibirá como premio un billete aereo a su pais de origen, desde los Estados Unidos en clase turística, con derecho a un acompañante, en un valor total que no exceda a $2,000 dólares. La estada en su pais, traslados, expensas con alimentación, transporte, autorizacion de viaje, visas, cuando necesario, e otras expensas que no sean los billetes aereos del ganador y su acompañante seran de responsabilidad exclusiva del ganador. Los premios no son transferibles. La sustitución de los premios o su canjeo por dinero en efectivo no están permitidos, excepto para Terra, que se reserva el derecho de sustituir un premio por otro de igual o más valor si el premio inicial no está disponible por cualquier motivo. Los impuestos, derechos y recargos sobre los premios serán responsabilidad única del ganador.
En caso de que el ganador sea natural de Cuba, Terra les dara el derecho de eligir cualquier destino en Latinoamérica.
4. PRIZES
One (1) grand prize winner and his or her guest will be awarded an airfare roundtrip ticket from the United States to his or her country of origin, which prize shall not exceed a total of $2,000.00 (Two thousand dollars)
Any expenses except for the airfare tickets, including, but not limited to lodging, transportation, travel authorizations, visas, if applicable, meals or any other expenses in the country of origin, are solely and exclusively bore by the winner. Prizes are not transferable. Substitution or cash redemption of prizes is not permitted, except by Terra, who reserves the right to substitute a prize of equal or greater value if the prize cannot be awarded for any reason. All taxes, fees and surcharges on prizes are the sole responsibility of winner.
If the winner was born in Cuba, Terra will allow him or her to choose any destination in Latin America.
5. CONDICIONES
La Promoción estará regida por estas Reglas Oficiales. Mediante el registro los participantes aceptan esta Reglas Oficiales y entienden que los resultados de la Promoción son finales a todos los respectos. Todas las decisiones referentes a la Promoción, incluidas la selección de los ganadores y la entrega de los premios, serán llevadas a cabo por Terra y serán finales y vinculantes.
Cada uno de los ganadores deberá completar, firmar y notarizar un affidávit de elegibilidad y relevo de responsabilidades y, si la ley lo permite, una autorización para publicidad. El Affidávit y Relevo de Responsabilidad de cada uno de los ganadores deberá ser firmado y devuelto a Terra dentro de los catorce (14) días posteriores a los que Terra envíe los formularios; si un ganador no entrega a Terra su Affidávit y su Relevo de Responsabilidad en el periodo de catorce (14) días, Terra se reserva el derecho de retener el premio y asignarlo a un nuevo ganador que se elegirá mediante sorteo de entre todos los participantes elegibles. Si alguno de los premios o sus notificaciones no se puede entregar, el ganador será descalificado y será designado en su lugar otro ganador.
Terra puede prohibir a cualquiera de los participantes la concurrencia a esta Promoción o cualesquiera promociones futuras, bajo su sola discreción, cuando (i) el participante haya mentido en el proceso de inscripción, (ii) haga caso omiso de las reglas repetidamente o (iii) actúe (a) de forma poco deportiva, (b) con intención de molestar, abusar amenazar o acosar a Terra o cualquier otro participante o (c) actúe de cualquier otra forma que impida el normal desarrollo de la promoción.
La Promoción puede ser terminada en cualquier momento después de su inicio y sin notificación previa; sin embargo se hará entrega de los premios.
La Promoción, y todas las promociones aquí relacionadas, están sujetas a las leyes y regulaciones federales, estatales y locales. La Promoción y todas las promociones aquí relacionadas, incluida la interpretación de estas Reglas Oficiales, estarán regidas por las leyes del estado de la Florida y, mediante el envío del formulario de participación, cada participante se somete a la jurisdicción personal de este estado.
5. CONDITIONS
The Promotion is governed by these Official Rules. By participating, entrants agree to these Official Rules, and understand that the Promotion's results are final in all respects. All decisions regarding the Promotion, including, but not limited to, selecting potential winners and awarding prizes, will be made by Terra, whose decisions will be final and binding.
The potential winners will each be required to complete, execute and notarize an affidavit of eligibility and release of liability and, where permitted by law, a publicity release. Each potential winner's affidavit and release(s) must be signed and returned to Terra within fourteen (14) days after the forms are provided by Terra; if a potential winner fails to return to Terra his/her Affidavit and Release(s) within such fourteen-day period, such potential winner’s prize will be forfeited and awarded to an alternate potential winner selected at random from all eligible entries. If any prize or prize notification is returned as non-deliverable, the potential winner will be disqualified and another potential winner will be selected in the original potential winner's place.
Terra may prohibit any entrant from participating in this Promotion or any future promotion if, at the sole discretion of Terra, such entrant (i) has tampered with the entry process or the operation of the Promotion or Website, (ii) repeatedly shows a disregard for the rules, or (iii) acts (a) in an unsportsmanlike manner, (b) with an intent to annoy, abuse, threaten, or harass Terra or any other entrant, or (c) in any other disruptive manner.
The Promotion may be terminated or extended at any time after its commencement without prior notice; however, any prizes due will still be awarded.
The Promotion, and all promotions relating thereto, are subject to all federal, state, and local laws and regulations. The Promotion, and any promotions relating thereto, including the interpretation of these Official Rules, are governed by the laws of the State of Florida, and, by submitting an entry form, each entrant submits to the personal jurisdiction of that state.
6. LIMITACION DE RESPONSABILIDADES
Terra no será responsable de ninguna información incorrecta o inexacta, ni de cualquier información remitida por los usuarios de la web o a cualquier equipo o programador asociado o utilizado por la Promoción ni por cualquier error técnico o humano que pueda tener lugar durante el proceso de inscripción. Terra no asume responsabilidad alguna por cualquier error, omisión, interrupción, eliminación, defecto, retraso en operaciones o transmisiones, fallos en la línea de comunicación, robo o destrucción o acceso autorizado o alteración de inscripciones. Terra no será responsable por los problemas, errores o mal funcionamiento técnico de las líneas telefónicas, sistemas informáticos en línea, servidores o proveedores, equipos informáticos o software o fallos de cuentas de correo electrónico por fallos técnicos, por saturación de líneas de internet o de cualquier sitio web o una combinación de las anteriores, incluyendo daños a los participantes o cualesquiera otras personas que participen o descarguen material de esta Promoción. Si, por alguna razón, la Promoción no funciona de la forma prevista, incluida infección por virus informáticos, bugs, falsificaciones, intervención no autorizada, fraude, fallos técnicos o cualesquiera otras causas fuera del control de Terra que corrompan la administración, seguridad, equidad y desarrollo adecuado de la Promoción, Terra se reserva el derecho, a su única discreción, de cancelar, terminar, modificar o suspender la Promoción y conceder por sorteo los premios entre las participaciones elegibles recibidas hasta el momento en que se tome tal medida. Terra no será responsable por las participaciones tardías, extraviadas, ilegibles, incompletas, robadas, distraídas, dañadas o no franqueadas. CUALQUIER INTENTO POR UN PARTICIPANTE U OTRO INDIVIDUO DE DAÑAR DELIBERADAMENTE UN SITIO WEB O IMPEDIR EL DESARROLLO LEGITIMO DE UNA PROMOCION O CONCURSO ES UNA INFRACCION DE LAS LEYES CIVILES Y PENALES Y SI OCURRIESE TAL CIRCUNSTANCIA TERRA SE RESERVA EL DERECHO DE EXIGIR RESPONSABILIDADES AL AUTOR HASTA EL LIMITE PREVISTO POR LA LEY.
6. LIMITATIONS OF LIABILITY
Terra is not responsible for any incorrect or inaccurate information or entry of information, whether caused by Website users or by any of the equipment or programming associated with or utilized in the Promotion or by any technical or human error which may occur in the processing of entries in the Promotion. Terra assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or authorized access to, or alteration of, entries. Terra is not responsible for any problems, errors or technical malfunction of any telephone network or lines, computer on-line-systems, servers or providers, computer equipment, or software, or any failure of email on account of technical problems or traffic congestion on the Internet or at any Website or combination thereof, including injury or damage to participants or to any other person’s computer related to or resulting from participating or downloading materials in this Promotion. If, for any reason, the Promotion is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Terra which corrupt the administration, security, fairness, integrity or proper conduct of the Promotion, Terra reserves the right at its sole discretion to cancel, terminate, modify or suspend the Promotion and to randomly award the prizes from among all eligible entries received prior to such action being taken. Terra is not responsible for late, lost, illegible, incomplete, stolen, misdirected, damaged or postage due entries. ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION/CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, TERRA RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW.
7. INDEMNIZACION Y DESCARGO
Mediante la participación en esta Promoción y cualesquiera otras aquí relacionadas, cada participante acepta relevar de cualquier responsabilidad a Terra así como a sus matrices, filiales y afiliadas, empleados, administradores, consejeros, agentes y representantes y mantenerles indemnes de cualesquiera perdidas, daños, derechos, reclamaciones y acciones de cualquier tipo incluyendo, sin limitación, daños personales, muerte y daños a la propiedad y reclamación basadas en derechos publicitarios, difamación, invasión de la privacidad que emanen directa o indirectamente de la Promoción o de la aceptación, posesión, uso o abuso de cualquier premio. Cada participante entiende y acepta que las partes no son ni pueden ser responsables por ninguna garantía o representación expresa o implícita, de facto o de iure, relativa a la Promoción o sus premios, incluida pero no limitada a su calidad o idoneidad para un determinado propósito.
7. INDEMNIFICATION AND RELEASE
By participating in the Promotion, and any promotions relating thereto, each entrant agrees to release and hold Terra, Inc., and its parents, affiliates and subsidiaries, and their respective employees, officers, directors, agents, and representatives harmless from any and all losses, damages, rights, claims, and actions of any kind including, without limitation, personal injuries, death, and property damage, and claims based on publicity rights, defamation, or invasion of privacy, either directly or indirectly related to or arising from the Promotion or from acceptance, possession, misuse, or use of any prize. Each entrant further acknowledges that such parties have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee expressed or implied, in fact or in law, relative to the Promotion/Contest or any prize, including but not limited to its quality or fitness for a particular purpose.
