Through this warning, Terra Networks Operations, Inc. d.b.a. Terra Networks USA] (hereinafter, "TERRA") informs the users of the different Internet portals it owns (hereinafter, the "Users" and the "Portal", respectively) as to its policy relating to the protection of personal data (hereinafter, "the Personal Data") in order that the Users may determine voluntarily and freely if they wish to provide TERRA the Personal Data that may be requested of them or that TERRA may obtain as a result of the registration or subscription for some of the services offered in the Portal or through the Portal. TERRA reserves the right to modify this policy in order to adapt it to new legislation or case law as well as common practice in the sector. Should such occur, TERRA will announce, on these pages, the changes to be made reasonably in advance of their coming into practice.
Certain services provided in the Portal may contain particular conditions with specific provisions as to the protection of Personal Data.
The Personal Data received by TERRA shall be processed by automated means and inserted in the corresponding automated personal data files belonging to TERRA and for which it is responsible (hereinafter, the "File"). For such purpose, TERRA will provide the Users with the technical resources necessary for them to provide their consent in order that TERRA may proceed with the automated processing of their Personal Data and in order that, prior to providing such consent, they may access this warning on TERRA's Data Protection Policy or any other relevant information. Except in those fields stating otherwise, answers to questions on Personal Data are voluntary, without a failure to reply thereto implying a reduction in the quality or quantity of the corresponding services, unless stated otherwise.
Some of the services offered in the Portal or through the Portal are directed at minors. As regards such services in which Personal Data must be provided, TERRA will always request parental consent in order that the minors may gain access thereto and their Personal Data may undergo automated processing as per this warning in TERRA's Data Protection Policy.
The purpose of the insertion into the File and the automated processing of the Personal Data is the maintenance of the contractual relationship established with TERRA, the management, administration, provision, expansion and improvement of the services which the User decides to use, subscribe or register to, the adaptation of said services to the Users' tastes and preferences, the analysis of the use of the services being made by the Users, the design of new services relating to said services, the sending of updates to the services, the sending, by traditional and electronic means, of technical, operational and commercial information relating to the products and services offered by TERRA or through TERRA, currently and in the future. Another purpose of the receipt and automated processing of the Personal Data is to send survey forms, which the User is not obliged to fill in.
TERRA has adopted the legally required security levels for the protection of the Personal Data and has installed all the technical means and measures available to it in order to prevent the loss, incorrect use, alteration, unauthorised access and theft of the Personal Data provided to TERRA. Notwithstanding the above, the User should be conscious that security measures in Internet are not impregnable.
TERRA intends to assign the Personal Data to the companies comprising the TERRA LYCOS Group for the same purposes as indicated in the preceding paragraph. In certain cases, TERRA intends to assign the Personal Data to third parties. When this is to occur, TERRA will duly warn the Users of this fact in the forms where they are to fill in their Personal Data, together with the identity of both the assignor company and the third party, the type of activities performed thereby and the purpose for the assignment. Both the companies belonging to the TERRA LYCOS Group and the third parties to which TERRA intends to assign the Personal Data may have their registered address abroad. In any event, TERRA guarantees the maintenance of confidentiality and the secure treatment of the Personal Data in the international movement thereof that may occur as a result of the assignment.
In particular, TERRA will assign to aremate.com, Inc. the following Personal Data: login, password, name and surname, e-mail, domicile, city, state or province, country, zip code and sex, belonging to Users registered as Portal Users, in the event that the User activates the link to the Auction Channel. Aremate.com, Inc. is a US company that offers, in its own name and on its own behalf, a service consisting of a virtual platform for the performance of online auctions. The data assigned by TERRA to aremate.com, Inc. may only be used by aremate.com, Inc. for the provision of such service to those Users that use it.
The Users hold and may exercise the right to access, cancel, rectify and oppose and also acknowledge their right to be informed of the assignments carried out by contacting TERRA by e-mail at terra@terra.com .
TERRA uses cookies when a User browses the web sites and pages of the Portal. Our cookies are only associated with an anonymous User and his/her computer and do not provide references that allow the deduction of the name and surname thereof. Thanks to the cookies, it is possible for TERRA to recognise the registered Users once these have registered for the first time, without them having to register on each visit to access the areas and services that are reserved exclusively for them. The TERRA cookies cannot read data from the hard disk or cookie files created by other suppliers. TERRA encrypts the user's identifying data for increased security. The User has the option of configuring his/her browser to warn of the receipt of cookies and prevent the installation thereof on his/her hard disk. In order to use the Portal, it is not necessary for the User to allow the installation of cookies sent by TERRA, notwithstanding the fact that, in this case, the User will have to register each time he/she accesses a service requiring prior registration.
